Why is this so personal?

I know some of you are wondering why is Victim T taking this whole situation so personal? I have even been called obsessed. I think a lot of people think they took a risk and should just kiss their money and credit good-bye and get over it. We probably would do that just to get on with our lives, but it is personal to me.

We were never involved in the North Minneapolis properties.

We grew up in the city of Minneapolis. My father taught at North High School for 30 years. Growing up, North Minneapolis was a very important part of our lives. I personally saw the struggles of the people that lived there and how many of them worked to make it a better place to live, including my Father. So the fact that these two came in and took advantage of people that were struggling to make a community a decent place to live literaly makes my blood boil.

When I told my father about the comments on the other blog stating "what is the big deal, North Minneapolis has always been a mess. What difference is a few more crack houses". He became extremely upset. He said, don't they realize that just because people are barely above the poverty level, dosen't mean that they do not care about their homes and community.

I remember wanting "designer jeans" growing up and my father would tell me about his students that would only have two sets of clothes to wear to school. One day they would wear one set while the other was being washed. But they did not care, they just wanted to go to school no matter what they had to wear just so they could get an education to improve their lives and those of their families. I am glad that I learned these important lessons from my Father. I wonder what lessons Jon and Tom's children are learning?

So when these two devils came into North Minneapolis and took advantage of the low priced houses to make large personal gains, I just could not even fathom how someone could do this.

Just because they do not live in a big Log Home on many acres in Chisago Lakes, or a Big house in Rogers/Maple Grove, does not mean they do not care if the house next door is boarded up.

Just because their house might be worth 150K vs. 1.5 Million they still care about it's market value.

The fact that I ever socialized with them, and had them in my home....truly makes me physically ill.

This is why this is personal to me...We care about North Minneapolis.

Why so personal for me? I thought I was a friend, business partner, they were someone I could trust. One day I walked by Jon's office, Tom was in there, and I over heard Tom say, they're credit isn't good any more, why do we need them? And Jon said, we don't, let's cut them lose. I then realized, I was never a business partner, never a friend, my wife and I were means to the end for them, nothing more. I was extremely hurt. They ruined our credit, (of couse they're names never went on anything) they lied about a company they created, they took kick backs on deals that they claimed were part of them doing business. Jon claimed to be the money man, but all the money again was coming from real estate commissions that we were unaware of. My wife and I were nothing more than guaranteed clients for their other enterprises.

Jon, Tom, if you are reading this? I am now solidly on my feet and will make sure you can NEVER do this to any one else again. Back then I had no money to fight you, I do now. And Jill, I know exactly how the money was used, and hidden by Tom. I'm sure you have long since cleared that safety deposit box you were hiding from the IRS. (Tom would request cash for doing appraisals so he and Jill could hide the income)

Unlike many of the people screwed by you, I know your inner workings and will use every file I kept, every detail I know to bring you down, and bring you down hard.

It looks like my patience is about to pay off.

Thanks for the information. I am so glad that you are also going after them. In their arrogance, they just assume no one has the energy/time to keep coming after them.

Hopefully more people will start to file lawsuits against them.

We are aware of one other individual civil case. But it is to our understanding that on behalf of the North Minneapolis community another lawsuit was just recently filed against TJ Waconia.

Their lawyers sure must be busy!!

None of this is personal to Jon/Amy Helgason and Tom/Jill Balko. Because the more I understand what they have done, the more I realize nothing is personal to them because they only care about themselves and material belongings.

Their only minimal hope of eternal savior is to confess to their sins, and sinned they have.

I have the word of a higher power that they will receive their due justice, both in this world and the next.

Sometimes no mercy is required....

Neither, he came to us personally. We had never heard of either of those companies. he positiioned himself as Complete Real Estate, including Complete Mortgage, etc. We had no idea he had all those phoney LLC's.

Did he approach you?

As for the LLC's look under the first post and in the FBI affidavit, you will see many of the LLC's. But we are certain there are many more.

I'm the one who blew Mr. Watkins cover on the BTM blog. I've had a few anonymous posts on your site too.

Now thanks to a poster on the Minnesota Forum site, they provided an address in FL to some property owned by Mr. Balko.

From what I understand, if you own a home in florida and are being sued, they can't take your property. SO maybe that is why he bought the Florida property.

I am not sure about Florida property laws. I think that if Fraud is proven, any assests are fair game. Not sure about the civil judgements, but my guess is the Feds can take anything they can find.

Does anyone know if they are still around?

OK, smart people. What is up with this entity called "TRG-HALLANDALE BEACH TOWER THREE LTD." Are they clean or are they dirty? Who owns them? Who is involved with them? Was this a real and actual sale of a $61k condo for well over $700k or is something else happening, here?

I used this as a search term, both with and without quotes:

TRG-HALLANDALE BEACH TOWER THREE LTD

Here is what I turned up. This entity has sold loads of condos in that particular development where Balko has his condo. The sales prices seem to range from $475k to $1.1M.

It is possible to see the names of all the various owners, all of Balko's neighbors. Some are people, some are LLC's like "LTD Investments, LLC." I didn't see any familiar names that have already turned up in this mess, but fresh eyes may see fresh patterns.

So those of you who are into this, try replicating my search and see if you recognize any of Balko's neighbors.

I was on the Florida secretary of State's website, and I found that "TRG, etc." (which may be a completely honest entity whose only link is honestly selling something to Balko) is part of this entity.

My response: how do you know and what else do you know? Is the condo project clean or dirty? Is this the only unit Balko owns in that Florida condo project, or are some of the names I see shells?

Do you seriously expect people to just go there and say "this is partly my condo?" Seems more like the feds would be seizing it in the proper way. It would be hard to believe the feds don't know about it. But does the media in Florida know about it?

I was not sure where this Hallendale Beach was so I looked it up. Thankfully, they are on the other side of FL from me!!

I do not know FL real estate law, just because I have a condo there. Why would any of us need to know who can claim your property if you are sued?? Only criminals would need to know this.

I know digging, but admittedly some folks know real estate a whole lot better than me. This is what somebody critical of my posting told me, off line, about the tax value of Balko's condo versus the sales price:

"That is common for any new structure to not have the
total appraised value listed until one year after an improvement is added to the land."

It certainly does sound reasonable to me.

So what is up with the condo at this moment? Is it finished? Is anybody living there? Is she cute? What is her phone number? (OK, I was being a bit too cheeky with the last two, even I will admit, but inquiring minds want to know)

I have, admittedly, never seen Tom or Jill or Jon. I have a picture of them in my head, but it is based on pure subjectivity.

But this brings up a whole new twist, and inquiring minds want to know:

Can this blog host photos? Are there photos of Tom and Jon which exist from the good ol' days, when money was sloshing around and the wine flowed like...well, like wine?

Are there pictures of the properties? Of the court proceedings?

Anything visual would rock. That would lend a lot of color.

I know about Florida property laws - not because I'm a criminal - but because I'm an educated person who reads. That is why having Florida as a primary residence can be a good idea ig you are going bankrupt. Here is some information on property protection. "Homestead Protection

In Florida, homestead exemption has two (2) meanings. The first is the one most people are familiar with, which entitles a homeowner to a $25,000 homestead property tax exemption. The second is less know but of extreme importance when it comes to asset protection. The Florida Constitution protects homestead property from judgment creditors. The Florida Constitution defines homestead as one’s principal place of residence up to one-half acre within a municipality and up to 160 contiguous acres outside city limits. The exemption does not protect the homestead property from tax liens, mortgages, homeowner association assessments, or from liens associated with labor or materials to repair or improve the homestead property."

Well, law is complex and always evolving. This might be a perfect case to challenge and further define this Florida "judgment homestead exemption."

For example, one might argue that property which can be proven to have been purchased with the proceeds of a criminal enterprise was not the kind of property those constitutional provisions were intended to protect. That's probably a winner.

One might further argue that property purchased AFTER the lawsuit was commenced is or should be exempt, since the purchase of the property is likely an attempt to, in effect, shield the assets from a future judgment, a misuse and misapplication of the law. Also probably a winner.

I mean, really, there's a zillion ways one might challenge that law in court in various ways and create a common law "Balko rule," especially with a set of facts as dubious as these.

The "principal place of residence" rule all by itself has a hole through which you could drive a truck.

Wouldn't it be something if fate turned the victims into partners in a time share?

What are the rules of that condo association about the condos being used as a time share?

Being able to see the tables turned on someone who talks all sorts of trash about someone and does it without having the stones to back their words by saying who they are... Is a sweet and satisfying thing.

I for one will be interested to see the response offered by the person who accused me of some very serious wrong doing (all of which were baseless and false, all because I stood up against what was popular and defended the character of my friend, Tom Balko.
What I find interesting (and many of you may as well) is that the very things this person accused me of.... This person has done themselves.

Add to that... it is a fact that this person was a partner with both Tom & Jon previously and his bio appears on another real estate investing site as well.
As I said on the other blog (behind the mortgage), I was not involved with the company as this person claimed and to this day, I did not see anything going on around that office that led me to think anything fishy was going on.
As I said before, Tom & Jon both treated me very well before and gave me no reason to think of them negatively.
I am also not challenging any of the "victims" on this blog. You have your opinions and I have mine.
At the least, I am sorry for those who honestly believe they were wronged.

Back to "blowing the cover" on an anonymous poster who was very involved with Tom & Jon.....

I stand by Tom. I stand by Jon. I stand by John & his wife (although I have to admit I never really knew what the dispute was all about).

See... I go on record against what is popular, because if someone treats me well as a friend, I tell anyone that they are a friend in return.

That said, if you (John S) were NOT the one who "outed" me previously, then I have two things to consider.....
1) Eating crow if I am wrong on who outed me and bashed me.
2) Try to figure out who else it might be that hates me for saying certain people are my friends.

Oh.... John, yes. I did go to Costa Rica for several months in '03. It was pretty cool there. Trip was cut short after I got bit by something in the rain forest & my arm swelled up like Popeye's and the local doctors told me, "Your arm infected bad. It close to blood stream."
I asked, "Que?"
They said, "You go home now."

BTW.... Sorry for the accusation if I really was wrong on the "outing."

Again, thank you jim for your help back then. I can respect your feelings for Tom, but he and Jon should have been stopped back then.

There many people who Jon and Tom did wrong by over time. I have an idea who it is, but he too was badly screwed, and will say nothing. But if you are who I think, you did not deal with Jim at all, so at the very least, be fair.

When questioned as to the validity of this claim, a website was posted, by a “Victim” where you could see the information for yourself . As there appears to be more than 1 Victim, I cannot say if it would be the same person, but the city of origin appeared to be the same. I reviewed that document and was amazed that this “Victim” claimed that it was for fixing up the North Side. If someone would have done just a little reading they would see that this was not in fact a “grant”, but a Certified Development Company Loan made by the Small Business Administration. Also known as a SBA 504 Loan, and yes it also states that this “assistance type” was a loan,(both direct and guaranteed). You will notice that in that same section was also a spot for an amount if it was “Grants And Cooperative Agreements”, of which there is no amount listed, NOT a GRANT ! So with what was indicated and not wanting to discredit the statement entirely by this “Victim”, researched the SBA and their 504 Loan, maybe there was an error of sort. Don’t take my word for this – read the information on the link provided. It clearly states under Eligible Business,“loans cannot be made to businesses engaged in speculation or investment in rental real estate”. Not to mention that their Business Plans must be reviewed and approved, as well as what they are borrowing against becomes “collateral, and personal guarantees are required”. I understand that this can be quite a rigorous process, as this is a LOAN given by the Government.“Berettahunter” in this same blog “stated that this was a loan for Dancer’s Edge”, one of their previous companies. Last time I checked, Maple Grove was not a part of North Minneapolis. And I think I may say with certainty that the “collateral” had a lien placed on it by the SBA. I at this point have been left with no question in my mind that this was NOT used to “fix up the North Side” of Minneapolis.

Please forgive me, but I must also question all on this blog. One “Victim” indicated that they had been in court and received a judgement for money that was owed them. So once again I need to question the facts. Did they show up in court? Did they contest to the fact that they owed you money? If they did NOT appear a judgement in your favor would be entered. Inquiring minds. I apologize, I am be able to find the information on these blogs, but am not willing to waste any more time in reading these blogs to answer this question.
Interesting information - this appears to put a different slant on these allegations. Previously someone pointed out that some information has been deleted, and asked why - some victim claimed that it was because of "infidelity" reasons, which may or not be appropriate. They also alleged that there was a discrimination on the part of the so called victims and their agenda. More interesting is that this information regarding a "so called Grant" has been deleted. Can someone explain this??? Inquiring minds!

I know Jon and Amy from maybe 15 years ago (before they married) and haven't seen them since. When we heard about this we were floored.

Look, the parties being charged here made the CHOICE to play with fire. They obviously knew what they were doing was suspect. When you participate in such activities, you cannot predict what negativity you will attract back. Lesson? Like attracts like and if you don't want drama, chaos, corruption, don't delve in it. For those who say they are "obsessed" with this case? Be very, very careful. Bring justice, let these people be a lesson to you and move on when the judge makes his decision.
