Hey all you Balko-Helgo supporters! Your boys are set to do some serious bids inside!!!

This is lifted from another blog: "The men remain free prior to a "surrender date" 6 weeks from now, but must go to prison on Thursday, May 28. The judge recommended Balko serve his sentence in Duluth, to be near his family, but the recommendation is not binding on the prison authorities. Any report of problems will cause the duo to immediately go into custody."

I'm hearing it's Eight years for Helgo and seven years for Balko + restitution (and more? probation after jail perhaps) is what I hear...

So for each and everyone who "believed" they were so very very innocent... Put that up your pipe and smoke it...

Wonder if either of them stashed some running cash?

How do two bankrupt people come up with $15,000 for expert testimony? which, by the way, hurt them more than helped. the judge clearly and openly rejected his testimony. I wouldn't be one bit surprised to see one of them try to flee...some still seem to think they have done nothing wrong.

2 men sentenced in $35M Metro mortgage scheme

The two owners of a Roseville real estate company were sentenced Thursday in federal court for mortgage fraud in connection with an estimated $35 million scheme involving at least 162 properties in the Metro.

Licensed real estate agent Jonathan Edward Helgason, 46, of Chisago City, was sentenced to eight years in prison and three years of supervised release.

Thomas Joseph Balko, 38, of Rogers, was sentenced to seven years and three years of supervised release. Restitution will be ordered at a later date.

According to their plea agreements, Helgason and Balko were the owners of numerous companies, including TJ Waconia, Total Title LLC, Complete Real Estate Services, Inc. and CityWide Management, LLC and Investor’s Warehouse LLC.

From 2005 to 2007, Helgason and Balko purchased approximately 162 properties throughout the Twin Cities area, principally in north Minneapolis. They would then resell the property within a few weeks to an "investor" who would purchase the property, sight unseen, at a price set by Helgason and Balko without negotiation, oftentimes $20,000 to $60,000 more than what they had paid.

According to the plea agreements, people were told by Helgason and Balko that the investors were simply "lending" their credit to TJ Waconia. In exchange for "lending" their credit, the investors would receive a kickback payment of about $2,500 and a promise of an additional payment after two years when the TJ Group was to repurchase the property from the investor.

Through the scheme, the defendants perpetrated a fraud on the lenders who were led to believe that the "investors" were the actual owners of the properties, when, in fact, the "investors’" ownership was in name only.

During the two-year period during which the investor owned the property, the TJ Group was responsible for all payments and maintenance on the property. In some instances, Helgason and Balko also provided investors with funds to pay the buyer’s portion of the property purchase price and worked with others to provide lenders with false loan applications on behalf of the investors so that they would qualify for the loan, according to the plea agreements.

The two men, on behalf of the investors, obtained $35 million to purchase the properties from the TJ Group. Ultimately, the scheme collapsed, and the TJ Group did not repurchase the properties or continue making payments to the investors in order to pay their mortgages.

The investors were left owning properties with mortgages that exceeded their property’s market value.

For once it would be nice if people knew what they were talking about, before posting on these blogs.
To the person that does not think that prisoners get good time if in a federal prison, think again.
It is called GCT, Good Conduct Time, and yes, even in MN they would qualify for it.
I myself do not see how this is a WIN. I am a victim, and with them sitting in prison, it will do me absolutly no good. They won't be paying any restution for years. How does that help me? I remembering reading, "let the punishment fit the crime," on JNS blog, and I have to agree, it would have been better for everyone involved if they were out, so they could help restore MPLS. Also they would then they would have to have a job that could start repaying me, and others.
So my belif is, is your were truely victimized, how can you be happy about this? I myself am pissed I have to wait years to start getting my money back.

My Commentary:

As we sat in the courtroom on the day of the sentencing, it was not a good feeling. I felt empathy for the family members of Helgason and Balko. Unfortunately, I do not think that this empathy was reciprocated to the victims. The victims did not bring this case onto them, the government did. The victims loses were not even utilized to come to the $35 Million Dollar figure. But then again, how do you quantify the cost to a family that has lost their credit, ability to purchase homes/cars, obtain college loans for their children etc., not to mention life savings?

I understand how difficult it must be to know a loved one is going away to prison and removed from you. But again, the victims had nothing to do with this decision. People say that this was nothing more than a bad investment, I disagree. The Federal Government does not prosecute firms/owners for legitimate investments that people lost money in. You must remember they broke the laws with how they managed this business, pure and simple.

I think Judge Ericksen was very fair in her assessment of Jon Helgason. He continues to be dishonest about his finances and responsibility in this case, even to the bitter end. But this is his character; he is a liar and a narcissistic sociopath. I realize that his family believes him and his stories, and I understand that. His sentence of 8 years is justified and the fact that she necessarily would not even support his wishes to serve his time in MN speaks volumes. I personally do not believe that a lengthy prison sentence is always the best solution. I think it would be good for him to serve some time for punitive reasons, but then be placed in a work release program to pay restitution. But victims do not set the legal guidelines on punishment.

I think Judge Ericksen was also accurate on her assessment of Tom Balko. I personally think he is not calculating like Helgason is. He seemed sincere about his apologies and I believe that he is truly remorseful about everything. In fact, I think that if he had not associated with Helgason he would not be in this situation. Jon probably fooled him just like he has everyone else. I wish his sentence was lighter, but I am glad he will be able to serve his time in Duluth so he can be near his family.

My comments regarding the hearing itself would be that Mr. Joe Dixon did a fabulous job describing this case and presenting the evidence.

Why they paid Professor Adams $15K is beyond me. If I was a juror I would have thought he was detrimental to their arguments. When two men’s futures are in very serious jeopardy, who uses funny stick figured cartoon slides? The fact that the slides depicted brokers using “liar loans” to obtain mortgages was extremely damaging to them. How was this supposed to help their case?

Both of their lawyer’s preparation, questioning, etc. was very poor.

In closing, I would just like to say I don’t think anyone feels good about this situation. The victims have suffered in so many ways, not just financial loses. I feel very sorry for the Helgason /Balko children and family members.
Hopefully the supporters of Helgason and Balko can one day understand that Tom and Jon really did cause severe harm to many victim families and show some understanding as well.

Thank you, for you are the only one that knows what is actually sensible. I agree 100% that prison time does nothing for anybody except making things worse. I personally know that if these two didnt do time in prison they would do everything in their power to help out the people they have un-intentionally wronged. Prison time just devistated the people involved, in this case the victims like you who have a sense of morality and the family of these two.

I understand that people are hurt by actions of tom and jon. I also believe that most people know that the government was on the defence side and not the victims. I also know for a fact that jon and tom both are sincere when the send appologies to people affected by this because i have been around long enough to know when jon is sincere about things. If you could see the sadness in his eyes when he talks about friends and clients that will not talk to him anymore. I hope you can find it in your heart to realize that these two both are sincere in apologies and have been even before the trial. by the way victim t, if you knew the effects that imprisonment had on people i am sure you would know that it is not right in any case. The only people that need imprisonment is violent criminals. Non-violent criminals that are put in prison just labels them which actually makes them more likely to re offend, in this case i know these two will not re offend. The effects it will have on their children and familys on the other hand is a whole other rhelm which people on this blog would not understand because it has to do with neurobiological statistics. probably beyond things you would understand. If you feel the need do some research and maybe you will have a change in heart.

I too like victim T thought I would be happy with the conclusion. To be honest it leaves me cold inside. Yes, Tom did some awful things. His children and so many other people are going to be affected by this. Please don't start with he did wrong I know thaat. What all of you need to realize is God is all about forgivness and all of you need to forgive and move on. I have read this blog sinse it started and never made a comment. At first I laughed at the nasty comments and agree with some. Im ashamed at myself that I did that. My life is full of happiness. Its time for all of you to move on and leave them alone. None of you will ever feel contentment until you see them all suffer. What does that make you?

Well, Tom and Jon signed a government document of FRAUD with all of the stipulations. “DID YOU NOT READ THE FINE PRINT”

We do not need think about this anymore.

We all know we will never see any money back, but we have our freedom.

They may have swindled our credit, but we still have our freedom. You cannot put a price on that.

T&J and supporters have the next 8 years to live with this. In fact they will have to live with it for the rest of their lives. The felony stamp never goes away.

No... they need to be held accountable for every single dollar because that means precious little prison spending money... No extras in the Fed Pen (aww... no Snickers Bar?) while their meager prison wages are garnished. It means that if they get time off for good behavior they still need to be paying out while working whatever great job a convicted felon gets after a sentence like theirs. And when they finally both become "estates" they are financially dried out before they are left to rot. I'm glad you agree they "owe millions" though... that shows everyone you have some knowledge of how rotten these two are!

I love this site! 1st time reader, long time acquaintence of these two crazy frat-boy felons!!! Did you know: The big guy (Brother "Donkeypunch" Helgason) actually got 11 years (8 years + 3 years probation after "hard 8" is finished)! That means the little one (Tommy "Chug Chug" Balko) gets a total of 10 years on his sentence.

Is anyone going to the restitution phase of this kegger? I would love to some photos of them in the prison garb...

Ask Jimmy "Ray-Way" Watkins if he remembers that 'Brenner Pass' drinking game back in the day!!!

The Judge said they do not need to be at the restitution hearing.

I am sure they will be notified in prison of how much they owe.

BTW, the government will be going back at least 3 years to investigate their assets and what/who they moved any money to.

I know Helgason's family had better be warned. If Jon does not come clean, maybe the Judge will make sure he does his full 8. Moving money to family members does not count towards "good behavior".

I'm sure the Feds and the IRS will want to make sure that anyone "holding coin" for T-bag and J-bird understand the tax and legal ramifications for such acts... I highly doubt Jill is the lucky treasure chest: isn't her dream house going "foreclosure - past redemption" pretty soon? Maybe there are a bunch of canning jars buried in some backyard in Victoria Minnesota somewhere... Rogers. Victoria. Saint Louis Park. Lindstrom. I seriously doubt anyone would bury a "treasure chest" in any of those places... Canning jars (Ball, Mason, etc) with money buried in the backyard is something only done on movies and tv shows... sheesh, dude.

If there is a 'cash stash' i'm sure that the smart thing to do would be to put it in a suitcase or duffle bag and give it to some trusted confidant who can weather state and federal scrutiny. These two geniuses will be so happy when it's handed back 10 years from now every single dollar will be there waiting to be spent once they are free men again.

The government is more interested in assest transfers such as cars, etc.

They can put items in family members names, but they are planning on finding out the time frame for these transfers.

Tom and Jon are not aware of this yet, as soon as the restitution is complete they will be.

An example of how it works; Amy will be allowed to keep one car and any necessary items such as the kids furniture,etc. The rest can be used for restitution. No motorcycles, extra cars, snowmobiles will be allowed to be kept.

This is not over for them or their families.

Anyone need a ride to Balko's cabin for the "final blowout" party??? It's going to be freakin' WILD (if the bar party was any indicator)!!! Balko was a "crazy GOD" and i'm sure he was all sorts of hung over the next day. Luckily he didn't have to see his kids after that blow-out... HANGOVER CITY!!!

Last time I got a loan for a mortgage all of my personal information that is on the application needs to be verified and signed by me. Also if I am getting a loan for a large amount of money for something such as a mortgage I know what I can afford and if someone can get me a loan for an amount I cant afford but I am willing to take the loan because its an investment then that is the investors problem.
my point is that all the investors that took advantage of the investment opportunity that did not pan out are just as guilty as them face it you would not be complaining if things paned out the way they intended things would be the opposite you would be loving them wishing you would have done more, what kind of person does this make you. dishonest, greedy. huh??
I highly doubt that they caused the depression we are in and if they are so talented to cause such an event across the country then they should not be in our prisons shit they should be the president, b/c that is talent and I would love to meet these two someday.

Any investment is only worth what one will pay for it and if a deal sounds to good to be true well then it might be. you made an investment and lost its like the stock market. prison will do nothing for them or you. your just paying more to house and feed them.

You supporters are the ones that do not get it. It was never a legitimate investment. It was set up to fail, that is why they are going to prison. Not because people lost money...it was FRAUD!!

You are correct, it was suspicious. That is why they abused their position of trust with friends. Friends believed them and trusted them. The victims are not just random people they found to invest. They used the guise of trusting a friend.

OK so lets say it was set up to fail. If you were a good investor you would have realized this and if it was such a good investment then why wouldn't you have done this on your own you would in the end make more money w/out the middle man with a little more hassle and you would have been forced to keep track of your $$ which is something any investor should do anyway.
maybe b/c you couldn't get the loan?? if that was the case then you should not have invested in the first place.
I don't think that there intentions were to lose those houses the way the market was going it appeared as if they would only go up in value and resale would be great. probably never thought of a back up plan. that is the problem people looked at real estate as an asset and not an investment when in reality the home is only worth what someone will pay when you sell until money in hand it is an investment, banks do this too and they still do.In this case you were the investors that paid and since you bought the house its your loss.
I don't think the intentions were to screw people. everyone involved made bad decisions I think prison time and especially the amount is very excessive and really helps no one. It's not really a good punishment either.
people learn a lot in prison and when you have just made it difficult for two bright guys to get legitimate jobs now they may be forced to find alternative ways. sometimes we create bigger criminals when they had good intentions to start with.

They did. To the tune of 10 years/11 years for FRAUD. They're going to Federal Prison (don't give me that "Country Club" song and dance, either... Jail is Jail). They may never pay back one single thin dime to anyone. But they will have financial restitution hanging over their worthless heads like a sword.

Focus people! These are two human beings that are going to prison for a very, very long time. Don't fight about whether or not there's phones and glass... don't spend time trying to distract everyone about talk of prison rape or if the place is a country club... It takes away from the fact that they are convicted felons who have been stripped of their names, given numbers and will now have to go to the bathroom in the same room they sleep in.

Actually there's still a large number of scumbag mortgage fraudsters (Marlon Pratt, Susan Newell, Ed Boler, etc) who are either in the process of being on trial for multiple count felony mortgage fraud or will soon be on trial. That should make for interesting viewing.

But that begs the question: What will YOU do? Go to "Dave & Buster's" to get your 'game on' while the two men you defended (T&J) sit in their institution for the few years??? Hardly fair, huh?

By the way: even in a "minimum" or "medium" security setting I think 'prison rape' jokes aren't really that funny. But after being convicted of felon "financial rape" Tommy & Jon-Boy will have a lot of time on their hands and their asses!

Hmm... maybe he's saying that Wadkins WON'T visit his "friend" now that Tom's getting busy in jail. Maybe, and just maybe, this person's implying that Jim "Brenner's Pass-Out" Wad't-kins will only visit Tommy "DonkeyPunch" Balko by chatting with him online via the internet. Texas is a long ways away from Duluth. Let's all agree that no matter what you hateful defenders of T&J hope to say here that we all agree they DESERVE TO BE BEHIND BARS for years and years...

IDIOTS! You know there is a wonderful thing on the internet called, GOOGLE. According to the Federal Prison Web site, prisoners CAN NOT use the internet. So it is highly doubtful that Watkins is chatting with his friend in prison.

Whoa! Easy there 'Napoleon Dynamite'. Obviously you're a little hotheaded when it comes to these two getting in touch with Mr. Watkins. I'm sure a LOT of people think it's great that Tom B. and Jon H. won't be able to update their Facebook pages or play online Tetris let alone text-chat with friends from Federal lockdown. I'm sure a LOT of people are sad that Tom B. and Jon H. will have to communicate with loved ones the old fashioned ways: through handwritten letters, long tearful phonecalls and using small mirrors/hand signals through the bars of their cells.

Since this is a Victims blog and the case has run its course, I was thinking that this blog could turn its focus to the victims.
What do I mean?
It should be easy to obtain a list of the victims that asked for restitution. Then put those names here on the Victims blog and sit back as the posts come rolling in from people the victims have victimized.
Should be fun.

Jon is in jail now, not sure about wife. Somebody asked about them hiding money. I don't know if they did or how much, what I do know is they got help from some dirt bags in Chicago. These are the same fine people who helped Mike Prieskorn get away with a ton of money. Prieskorn is a MN native who ran a company like Helgasons called Blackstone. You can read about Prieskorn at Ripoff Report.com .
These folks in Chicago ( Doug Leiter, Jack Gallardo and J.V. Springman ) use Unincorporated Associations as holding companies. They set them up using nominees and then sell them to guys like Jon and Mike to hide their ill gotten gains.
It works quite well and may even be legal, morality seems a lesser concern.

wow,i came to this site to hear facts and i appreciate the wise individuals who give them. i am a Chisago local and just wnated to try to read the facts. i feel for all the victims, and i am angry because, don't kid yourselves, this effects the whole country. there is alot of this going on and those of you who say they dont belong in prison????? where do they belong then??? please answer me that?
as far as the victims, i do feel for you and i'd be angry, but unfortunately some day soon, i hope you can find a way to move on. Life is short, love and appreciate what you have left. god bless.

I grew up with Jon in armstrong iowa. i just have a hard time believing that this is the same person. the bottom line is i hope Jon is given a chance to make this right with the people that were harmed in his actions. this is the way he was raised.

You should write Jon while he's in prison and remind him of his days in Iowa. Given his confirmed guilt and subsequent sentence in this matter it might be a good topic for him to reflect upon... I'm sure the remainder of his life will be of a quality much less that what he became accustomed to during the height of his criminal activity... thoughts of a more simple and innocent era in his life might bring him some peaceful moments while he sits behind bars...

The asshole is is out and is dating my siter i dont like him and searched his name because he could not look me in the eye and my gut said something was wrong, so i googled him and he is working on section 8 housing i think hes at it again somehow.
